BBC Children in Need Chaperone Special Terms

In the event of any conflict between the overarching BBC CiN Terms and Conditions and these Special Terms, these Special terms will prevail.

1. Definitions
Terms defined in the overarching Terms and Conditions shall apply to these Special Terms, unless expressly stated otherwise. In addition, the following terms shall have the following meanings:
“Chaperone” means a person aged over 18 years, who is approved under Regulation 15 of The Children (Performance and Activities) (England) Regulations 2014, to have care and control of a child to safeguard, support and promote the well being of the child while he/she is taking part in a performance, rehearsal, activity or living away from home during the period of the Licence.
Chaperones act in loco parentis and exercise the care that a good parent might be reasonably expected to give a child.
The “Licence” is legal authorisation for a chaperone to supervise a child while he/she is taking part in a performance, rehearsal, activity or living away from home.
2. Chaperone Duties and Responsibilities
2.1 Your primary responsibility as a Chaperone is to ensure the welfare and supervision of the child(ren) in Your care
2.2 You must be cognisant with legislative requirements, including but not limited to either The Children (Performances and Activities) (England) Regulations 2014 or The Children (Performances and Activities) (Scotland) Regulations 2014
2.3 You must be familiar with BBC CiN’s Safeguarding Policies as provided to you by your booker or BBC CiN Contact and, where applicable to your engagement, with the BBC’s Safeguarding Policy and the BBC’s Editorial Guidelines. Both can be found here:
2.4 You must provide evidence of completion of the NSPCC online course ‘Protecting Children in the Entertainment Industry’ (within 3 years)
2.5 You must ensure that the child has suitable opportunities for recreational activities and is protected from stress, strain, bad weather and any other conditions likely to harm them.
2.6 You must maintain contact with Your own Licensing Authority (if applicable), the child(ren)’s Licencing Authority, the Local Authority in whose area the child is performing, the child’s agent (if applicable) and the child(ren)’s Parent/Legal Guardian.
3. Chaperone and Child Licences and PVG Scheme Membership
3.1 It is a condition of Your engagement as a Chaperone that You have in place either:
3.2 If You are an English, Welsh or Northern Ireland based Chaperone, a valid Chaperone Licence issued by Your Local Authority and You shall provide a copy to BBC CiN or the BBC (as directed) upon request.
3.3 If You are a Scottish based Chaperone, a PVG (Protecting Vulnerable Groups) Scheme membership and You shall provide BBC CiN or the BBC (as directed) with either upon request.
3.4 If You have warranted that You have in place a valid Chaperone Licence, an in-date Enhanced (with Children’s Barred List) DBS Check, or that You are a member of the PVG Scheme (as appropriate), You agree to confirm any changes to that position during Your engagement with BBC CiN or before accepting any further work.
3.5 You agree to make Yourself thoroughly familiar with the terms of the Licence of the child You are chaperoning and be familiar with the licences granted by the Local Authorities, and as within Your abilities You should ensure that any conditions of the Licences are fulfilled.
3.6 You warrant that the child(ren) that You are chaperoning has in place a valid licence and will provide that licence to BBC CiN or the BBC (as directed) on request
4. Data Protection
You may process Personal Data from time to time in the course of performing your obligations under the Contract as follows:
Categories of Data Subjects: children/young people being chaperoned and their parent/guardian Types of Personal Data: name, address, date of birth/age, key information or “story”, details of any particular issues including, without limit, health issues, the call sheet, child/young person’s parent/guardian’s: emergency contact details.
Necessary Purpose of the Processing: solely for the purpose of providing the services or deliverables set out in Your Booking / Booking Contract.
You must comply with the overarching Terms and Conditions when Processing such Personal Data.
