BBC Children in Need Logo Use Terms
Please read our logo use terms and privacy statement below
We are BBC Children in Need (charity no. 802052 in England and Wales and SC04723022 in Scotland).
These licence terms apply to your use of our name and any of our logos that we provide to you (the ‘trade marks’). The trade marks are owned by the British Broadcasting Corporation (the BBC) who grants you this licence.
1. You may only use the trade marks on items agreed with us and must only use the items for the purpose of fundraising for us via the relevant fundraising activity that we have agreed with you. The items may only be distributed in the UK (or, if on an internet page, directed at the UK).
2. You must not use the trade marks on products (as opposed to marketing or fundraising materials) unless we have specifically approved this in advance by email.
3. We reserve the right to ask you to send samples of the items on which you propose to use the trade marks. If we do, you must promptly send them to us and comply with any changes that we request you to make.
4. You may only use the version of the trade marks that we have supplied to you and must not adapt or change without it our prior written agreement (which may be via email).
5. Any fundraising materials that you create must include our registered charity name and registered charity location and numbers which are set out at the top of this licence.
6. Your fundraising materials should make it clear that the fundraising is being carried out by you (in aid of us). It is not being carried out on behalf of, or endorsed by us or the BBC.
7. You may only use the trade marks on the item(s) whilst you are carrying out your relevant fundraising activity that has been agreed with us and must stop using them once you have finished it. You will also stop using the trade marks earlier if: (i) we and/or the BBC instructs you in writing to stop because you have not complied with the terms of this licence; or (ii) because you become insolvent; or (iii) because you are a company and you undergo a change of control; or (iv) because your use of the trade marks infringes the rights of anyone else; or (v) because you do anything which brings or is likely to bring the reputation of us or the BBC into disrepute.
8. The manner in which the item(s) is/are used will comply with any relevant guidelines that we notify you of and with any relevant laws, codes of practice, standards and regulations, will be in keeping with the editorial integrity and reputation of the BBC, us and the trade marks.
9. You acknowledge that the BBC is the owner of the trade marks and any copyright in them and of the goodwill relating to them, and that the benefit of the use of the trade marks by you will belong to the BBC. You will not make or attempt to make any trade mark application in relation to the trade marks. The BBC gives no warranty that there are no conflicting third party rights in the trade marks in any part of the United Kingdom of Great Britain and Northern Ireland, the Channel Islands and the Isle of Man.
10. You will not use the trade marks in any way or for any purpose other than as set out in this licence, nor make use of the name of the BBC, us or any of our or the BBC’s trade marks except under this or any other written licence granted to you by the BBC.
11. You will not allow anyone else to use the trade marks or, transfer, sublicense or in any other way dispose of your rights under this licence.
