Just Dance for Pudsey privacy notice

We are committed to protecting your personal information. We want your interactions with us to be safe and enjoyable. This Privacy Notice describes how we collect and use personal information about you during and after your relationship with us.

When you provide information to us, BBC Children in Need is the data controller of your personal information and we are registered with the Information Commissioner’s Office with registration number Z1523450.  BBC Children in Need is a company limited by guarantee (number 04723022) and a charity registered in England and Wales under number 802052 and in Scotland under number SC039557.

BBC Children in Need will collect and process the personal information that you have provided to us about yourself during your interaction with the BBC Children in Need Just Dance for Pudsey Competition.

 

This personal information is : 

  • If you are entering the school ballot:The name of your school, the school address, the team name entering the Just Dance for Pudsey ballot, your song choice (either Eye of the Tiger or Radioactive) the teacher/school employee name and school email address and local authority name for children under 18 years of age.
  • If you are entering the family ballot: The parent/guardian name, parent/guardian address, the team name, your song choice (either Eye of the Tiger or Radioactive) and parent/guardian email address and local authority name for children under 18 years of age.

The personal information will be processed for the following purposes:

  1. to allow you to enter your team into a ballot using Uploader to submit your nomination (including storing your nomination). The Uploader is a BBC service and the BBC has let us use it so you can easily send us your nomination. BBC Children in Need and the BBC will share your personal data with each other and are joint data controllers of your and your nominee’s personal data.  We will handle your personal data in accordance with agreements in place between us which require each of us to process your personal data in accordance with the law;
  2. for us to review the nomination to see if it meets our requirements;
  3. to use the nomination as set out in the Terms and Conditions;
  4. to contact you about your nomination if we need to;
  5. to contact the local authority to request the issue of a Performance License in order for a winning child to miss school on Friday 10th November 2023 to perform on the Live Show (Please note if you are successful in the ballot, we use your information to carry out age related checks and production and editorial checks for participation in the Live Show. In this case we will ask you to read another privacy notice prior to this processing and sign release forms);
  6. to make arrangements with you to attend the Live Show if you win the ballot;
  7. to retain details of the winner and shortlisted nominees of the award for our legal purposes; and
  8. to retain personal data in accordance with the contact permissions you have given us.

 

Legal Basis for Processing:

The legal basis on which BBC Children in Need processes your personal information is that it is in our legitimate interests to undertake fundraising and related activities to further its charitable aims.

If you are under 18 you will need to ask your teacher or parent/guardian to complete the details and they must nominate your team via Uploader.  They will be responsible for obtaining consent for team members under the age of 18 from the child or young person’s parent/guardian. For processing your personal data for your use of the Uploader, the BBC’s lawful basis is the performance of its public task (the BBC’s role is to act in the public interest and to serve all audiences with content which informs, educates, and entertains).

BBC and BBC Children in Need also have a legal obligation to process the personal data of those shortlisted and winner(s) in order to comply with relevant competition regulations.

The legal basis on which we  processes your personal data for the verification checks detailed above is the BBC and BBC Children in Need’s Legitimate Interest to protect our reputations.   If we process your special category personal data and/or criminal convictions data, the BBC will process this data on the basis of substantial public interest to protect its reputation and BBC Children in Need will process this data on the basis of your consent.

We do not believe this unreasonably impacts on your rights and freedoms.

 

Other parties who receive your data:

As the Live Show is produced by the BBC we may share your information with the BBC and other BBC Group Companies including BBC Studios Limited and BBC Studios Productions Limited.

 

BBC and BBC Children in Need Verification Checks

The BBC and BBC Children in Need may carry out verification checks on the proposed winners and ask you about any criminal convictions and offences (including any civil cases, allegations or investigations that are being carried out).  It is important that the BBC and BBC Children in Need is aware of anything in the nominee’s background that could have the potential to bring the BBC or BBC Children in Need into disrepute.

These verification checks include but are not limited to:

  • Internet searches
  • Searches of any publicly available social media accounts you hold
  • Searches carried out for global, regional and local newspapers
  • Newswires
  • Industry publications, magazines, reports
  • Other sources, such as government website and publications
  • Asking you to disclose details of any criminal convictions and offences (including any civil cases, allegations or investigations that are being carried out) and asking you to keep us up to date about this

Subject to the outcome of these searches, the BBC and BBC Children in Need may also carry out further verification checks using a third party who also carry out verification checks via publicly available sources.

Personal data about you that will be used for this purpose

  • Your name
  • Your postcode
  • Your email address
  • Contact number
  • Any other information you give to us
  • The verification search results which contain your stories, experience and opinion, professional qualification/disqualification, sanctions placed on you, involvement in civil and criminal actions and so on.

Depending on the search results, the BBC and BBC Children in Need will also collect and process special categories of personal data. This might include for example:

  • Health related data
  • Race or ethnicity data
  • Religious or philosophical beliefs
  • Sexual orientation

 

Retention of your data:

Unsuccessful ballot – If you enter the ballot and are not successful in being selected to perform at the Live Show we will retain your information for 3 months or until we have verified the teams for the Live Show and then your personal information will be deleted.

Successful ballot – If you are randomly selected in the ballot to participate in the Live Show, we will retain your personal information until 3 years after the Live Show.
