Your Privacy

BBC Children in Need will collect and process the personal information that you have provided to us about yourself and the fundraiser of the year for the purposes of:

  • Contacting you about your submission.
  • Administering the Award and any related promotional activity.
  • Other opportunities not related to this year’s Fundraiser of The Year Award to be involved with BBC Children in Need (if you have told us below you would like to be contacted about such other opportunities).

We will also retain details of the winner of the Award for our audit purposes.

The legal basis on which BBC Children in Need processes the personal information is our legitimate interests of fundraising (and we don’t believe this unreasonably impacts on your rights and freedoms).

We may share information you provide with BBC Group Companies including the British Broadcasting Corporation, BBC Studios Limited and BBC Studios Productions Limited (known as BBC from now on) for the purposes of them:

  • Contacting you about your submission.
  • Administering the Award.
  • To contact you about your submission being featured on BBC platforms or you being involved in other related promotional activities or other BBC opportunities not related to this year’s Fundraiser of The Year Award (if you have told us them you would like to be contacted about such other opportunities).
  • Retaining details of the winner of the Award for their audit purposes.

Please be assured that your response to this contact and any communication with the BBC, will not impact your entry, should you choose to enter. BBC Children in Need’s Privacy Policy includes contact details and how to exercise your rights and the BBC’s Privacy Policy is available at http://www.bbc.co.uk/privacy.

If you enter someone else for fundraiser of the year you are confirming to us that you have obtained their or, if under 18, their parent or guardian’s permission beforehand and that they have been given the privacy information contained here. We and the BBC may also announce the name and county of the shortlisted nominees and winner.

Nominees may be asked by the BBC to disclose details of any and all criminal and civil actions pending against them, or served against them plus any unspent convictions if this is required the BBC will ask the nominee to sign a consent form at the time. Nominees asked for this information must keep us informed of any changes to that disclosed up to the point the winner is announced. This information will be handled in the strictest confidence and, as with all personal information, in accordance with the BBC’s Privacy Policies – see above.

Following standard industry practice, the BBC may undertake background checks of the nominees, if required the BBC will ask the nominee to sign a consent form at the time. Information discovered, or that may have been disclosed by the nominator or nominees themselves will inform the decision as to the selection of the winner.

The winner (including all members of the winning group, organisation or similar) will also be required to sign a BBC/BBC Children in Need Personal Declaration Form.

By making a nomination, you agree to be bound by these terms and conditions.

Terms and Conditions

1. Eligibility

1.1  Nominees must be residents of the UK, Channel Islands and the Isle of Man. You may nominate yourself or someone else. BBC Children in Need reserve the right to encourage applications in any way it sees fit.

1.2  Nominees may be individuals, groups of people, an organisation or similar. However, we may exclude nominees that have been paid for their fundraising, or any corporate-backed fundraising and volunteer work.

1.3  Nominees must not be current employees of BBC Children in Need, the BBC (or any of its group companies including BBC Studios Limited and BBC Studios Productions Limited from now on known as BBC), their close relatives or any person connected to the Award.

1.4  Nominees must have organised or participated in raising funds for BBC Children in Need between 22nd October 2018 and 20th October 2019 (inclusive). We cannot consider any fundraising that was not wholly carried out in aid of BBC Children in Need.

1.5  Nominees must be able to provide proof of payment of funds to BBC Children in Need if requested.

1.6  You, the nominator, must be at least 18.

1.7  Nominees may be under 18 years old but, if they are, you must obtain permission from their parent/legal guardian before you nominate them and must provide their parent/legal guardian’s contact details on request. By nominating them you confirm that you have obtained this permission. If a nominee under 18 wins, they must be accompanied by a parent/legal guardian to the Appeal Show or any filming.

1.8  Successful nominees must:

  • Be available to be contacted between 21st October 2019 and 15th November 2019.
  • Be available for the award ceremony to be filmed on a date to be determined between 8th November 2019 and the 15th November 2019 or live on the BBC Children in Need Appeal Show on 15 November 2019.
  • Agree to take part in any filming, broadcast and publicity relating to the Award if required (any filming will take place between 21st October 2019 and 15th November 2019). This may include for The One Show, BBC Children in Need Appeal Show, other BBC and/or BBC Studios Limited programming or related websites or social media.

1.9  You (as the nominator) must obtain permission from the nominee(s) before nominating them and to make them aware of these terms and conditions, in particular the requirements under section 1.8 above.

2. Open and closing dates

Nominations open on 2nd September 2019 at 7pm and close on 20th  October 2019 at 23:59pm. Forms must be received before this date/time and any nomination forms received after this date/time will not be considered.

3. How to enter

3.1  To nominate:

3.2  We cannot accept any responsibility for any problem with the postal service, which may result in any entry being lost or delayed. Proof of sending is not proof of receipt.

3.3  There is no restriction on the number of nominations you may make.

4. How the winner will be chosen

4.1  There will be one winner (be that one individual or one group, organisation or similar).

4.2  The aim of the Award is to celebrate an individual, group or organisation that has shown great creativity, commitment and inspiration to raise money for BBC Children in Need. The level of money that has been raised is secondary, as the aim is to celebrate the imagination and determination required in fundraising in a bid to inspire others to take part and join in.

The winner of the Award needs to have displayed the following attributes and nominations will be judged on such criteria:

  • Shown great creativity in fundraising.
  • Shown great inspiration in fundraising.
  • Shown great determination in fundraising.

Nominations will be judged through the process outlined below:

Shortlist:

A shortlist of a maximum of 10 nominees will be chosen by the BBC Children in Need and BBC teams.

Shortlisted nominees may be required to be featured on The One Show, other BBC Programming, BBC Children in Need website and social media channels, so all shortlisted nominees must be prepared to be filmed. Any filming will take place between 21st October and 15th November 2019.

We will contact you (as the nominator) on or around the week commencing 21st  October 2019 by telephone or email if your nomination has been successfully short listed. Due to time constraints, if we cannot get hold of you and/or your nominee(s) by 5pm on 25th  October 2019 we reserve the right to exclude your nomination from the shortlist.

If you do not hear from us, this means your entry has not been chosen for the shortlist this time and we won’t take your entry any further.

Winner:

A separate judging panel will review each of the shortlisted nominees and choose a winner. The judging panel will consist of representatives of: Sir Terry Wogan’s family (if available), BBC Children in Need and the BBC Children in Need Appeal Show. An independent judge and one member will be elected as the Chair to determine the outcome in the event of a tie.

4.3  The panel’s decision is final and no correspondence relating to the Award will be entered into. Unsuccessful shortlisted nominees will be contacted by no later than 8th November 2019.

4.4  The winner will be announced to the public at a time and date to be determined by us in our sole discretion which may be during the Appeal Show, on The One Show, other BBC and/or BBC Studios Limited Programming, our website or elsewhere. The winner will be contacted beforehand by no later than 8th November 2019 but we may not announce that they have won until we have made the announcement public.

5. The Award/Prize

5.1  The Sir Terry Wogan Fundraiser of the Year Award 2019 will be awarded to the winner at a pre-recorded presentation ceremony filmed between 8th November 2019 and 15th November 2019 or live during the BBC Children in Need Appeal Show on 15th November 2019, as decided by BBC Children in Need.

5.2  The winner will also be invited to attend the filming of the BBC Children in Appeal Show in London on the 15th November 2019. If the winner is an individual, they may bring one companion. If the winner is a group, organisation or similar, then a maximum of four people may attend from the group. Any under 18s must be accompanied by their parent/legal guardian (who will count towards the permitted numbers above).

5.3  The prize includes:

The following for the winner and one companion (if the winner is an individual) or for a maximum of four individuals from the group (if the winner is a group, organisation or similar).

  • Return standard travel from the winner’s UK base to the hotel booked by us, plus transfer from the hotel to the filming location of the presentation ceremony.
  • One night’s accommodation at a London hotel if deemed necessary by BBC Children in Need due to the timing of the filming of the presentation ceremony, on a room only basis based on two people sharing a double or twin room (at the winner’s choice subject to availability).
  • Return standard class travel from the winner’s UK base to the hotel booked by us plus transfers from the hotel to the Appeal Show.
  • Tickets to the Appeal Show.
  • One night’s accommodation at a London hotel on the night of the Appeal Show on a room-only basis based on two people sharing a double or twin room (at the winner’s choice subject to availability).

Plus for the winner:

  • The Sir Terry Wogan Fundraiser of the Year Award Trophy (note there is only one trophy regardless of whether the winner is an individual, group, organisation or similar).

5.4  For the avoidance of doubt, unless expressly stated in these terms, no other expenses, costs, fees or other sums will be paid by us including, without limit, any additional hotel charges.

5.5  The winner (or their parent/legal guardian) must let us know of any disability or accessibility requirements in advance.

5.6  We reserve the right (at our discretion) to substitute the monetary value of the prize with a prize of equal or greater value. If for any reason, the Appeal Show is cancelled, there is no substitute available.

6. Promotion and Publicity

6.1  If additional filming for the presentation ceremony is required, the BBC and/or BBC Studios Limited will pay reasonable travel costs.

6.2  In the event of filming, any mobility issues or specific needs should be declared in advance so we or the BBC and/or BBC Studios Limited can ensure that any assistance that may be required (for example accessibility or mobility issues for studio filming) can be arranged in advance.

6.3  If you (the nominator) or a nominee provide any images or videos to us or the BBC and/or BBC Studios Limited in connection the nomination, you or the relevant nominee (as applicable) will retain copyright in such material but grant to us and the BBC and BBC Studios Limited the perpetual, royalty free, worldwide right to use, reproduce, publish, broadcast and exhibit such videos or images in any media and across any platforms. No fees will be payable for any of the above uses. You/the nominee (as applicable) must ensure that you have permission to share the images or video for such purposes including, without limit, the permission of everyone featured in the images or video. By submitting the images or video to us you or a nominee (as applicable) confirm that you/the nominee have such permission.

6.4  Neither you (as a nominator) nor any nominees can exploit the Award itself or any other element of this Award process. Neither you nor any nominees are permitted to make use of any of the BBC’s trademarks or copyright works (except as permitted by law) now or in future.

6.5  We cannot guarantee that you or any nominees will be filmed or featured in publicity in any way and we and the BBC and/or BBC Studios Limited are not obliged to film or use any film, material or other content in any way.

6.6  The above travel and hotel costs are only in relation to any filming for the winner of the competition. If the BBC and/or BBC Studios Limited contact you in relation to filming for any other competition promotion or in regard to your fundraising in general and you agree to take part, expense will be agreed on a case by case basis

7. General

7.1  We may disqualify any nomination or nominee which breaches any of these terms and conditions or acts fraudulently in any way. Depending on the age of the nominee, the BBC and/or BBC Studios Limited or we will obtain appropriate child licences for nominees (including the winners) if deemed necessary. Parents or guardians will be required to provide appropriate documentation to assist if licensing is required. If after reasonable attempts we or BBC and/or BBC Studios Limited cannot acquire this documentation, the nominee may be disqualified.

7.2 We reserve the right to disqualify shortlisted nominees and/or any winner if they cannot take up any element of the Award/prize, cannot undertake any elements of the filming or stages in the Awards as detailed above or if consent to time off school or licenses cannot be obtained. We reserve the right to offer that position to the next best entry.

7.3  We may cancel the Awards at any stage, if deemed necessary in our opinion, or if circumstances arise outside its control.

7.4  We, our sub-contractors, subsidiaries and/or agencies cannot accept any responsibility whatsoever for any technical failure or malfunction, or any other problem which may result in any nomination being lost or not properly registered.

7.5  We may amend these terms and conditions at any stage and in any way.

7.6  These terms and conditions are governed by the laws of England and Wales.

7.7  To the extent applicable, certain elements of the BBC’s code of conduct for competitions will apply to these Awards.
