Uploader: BBC Children in Need and BBC User Privacy Notice (Sir Terry Wogan Fundraiser of the Year Award)

We want to let you know that your information is safe with us. This is just a quick word to let you know how we handle your information when you send your nomination to us on this Uploader.  The Uploader is a BBC service and the BBC has let us use it so you can easily send us your nomination.   BBC Children in Need and the BBC will share your personal data with each other and are joint data controllers of your and your nominee’s personal data.  We will handle your personal data in accordance with agreements in place between us which require each of us to process your personal data in accordance with the law.  We work with approved third-party providers who help us to provide some of our services. These partners only use your personal data on behalf of us and not independently of BBC and BBC Children in Need.  We will not share your personal data with any other third-parties unless required or permitted by the law.  If you want to exercise your data protection rights, you can contact either the BBC or BBC Children in Need.  BBC Children in Need and the BBC will only use your personal data:

  • to allow you to use the Uploader to submit your nomination (including storing your nomination);
  • to do the verification checks detailed below;
  • to review the nomination to see if it meets our requirements;
  • to use the nomination as needed as set out in the award Terms and Conditions, including administering the award and any related promotional activity;
  • for other opportunities not related to this year’s award to be involved with the BBC or BBC Children in Need (if you have told us you would like to be contacted about such other opportunities);
  • to contact you about your nomination if we need to;
  • to retain details of the winner and shortlisted nominees of the award for our legal purposes; and
  • to retain details in accordance with the contact permissions you have given us.

What information do you ask me for?

We’ll have all the information you send or provide to us, any information from your BBC account if you have one and any information from the verification checks detailed below. If you nominate someone else for fundraiser of the year you are confirming to us that you have obtained their permission beforehand and that they have been given the privacy information contained here.

Why do you ask me for it? How can the BBC and BBC Children in Need use my information?

If you win or are a shortlisted nominee, we might publicise your name, age and county!

We’ll use the information you provide and your account information (such as name, email address, date of birth/age, gender and location) to make the Uploader personal to you and to run the award.  We may use your details to send important messages to you about your nomination.   We’ll only use your information as set out in this privacy notice.

How long will you keep my information for?

Your nomination and information will be kept for six months and after that will be deleted.  But if your nominee wins or is shortlisted we will keep their and your details for 2 years and if you and/or your nominee do appear in the BBC Children in Need Appeal Show your/their personal data will be held in our archives forever.  Any information about you in relation to your BBC Account will be kept in accordance with the BBC Terms.

The personal data collected will be stored within the UK and EEA and will only be shared with third parties as set out in this privacy notice.

Publicity

If your nominee wins or is shortlisted you and your nominee may appear in the following:

  • BBC Children in Need website and social media, other websites and social media- on the BBC Children in Need website, and social media to support the BBC Children in Need Appeal Show and in respect of the work that BBC Children in Need does all year round. We may also share across other websites or social media as part of a marketing plan.
  • BBC Children in Need Written Publicity / Promotional Material- for BBC Children in Need’s Annual Report, Fundraising Pack, e-letters and other materials sent to fundraisers and corporate partners of the charity.
  • BBC Programming– featured on BBC Radio 2, the BBC Children in Need Appeal Show, Morning Live, other BBC Programming.

BBC and BBC Children in Need Verification Checks

The BBC and BBC Children in Need may carry out verification checks on the proposed winners and ask you about any criminal convictions and offences (including any civil cases, allegations or investigations that are being carried out).  It is important that the BBC and BBC Children in Need is aware of anything in the nominee’s background that could have the potential to bring the BBC, BBC Children in Need or the Sir Terry Wogan Fundraiser of the Year Award into disrepute.

These verification checks include but are not limited to:

  • Internet searches
  • Searches of any publicly available social media accounts you hold
  • Searches carried out for global, regional and local newspapers
  • Newswires
  • Industry publications, magazines, reports
  • Other sources, such as government website and publications
  • Asking you to disclose details of any criminal convictions and offences (including any civil cases, allegations or investigations that are being carried out) and asking you to keep us up to date about this

Subject to the outcome of these searches, the BBC and BBC Children in Need may also carry out further verification checks using a third party who also carry out verification checks via publicly available sources.

Personal data about you that will be used for this purpose

  • Your name
  • Your postcode
  • Your email address
  • Contact number
  • Any other information you give to us
  • The verification search results which contain your stories, experience and opinion, professional qualification/disqualification, sanctions placed on you, involvement in civil and criminal actions and so on.

Depending on the search results, the BBC and BBC Children in Need will also collect and process special categories of personal data. This might include for example:

  • Health related data
  • Race or ethnicity data
  • Religious or philosophical beliefs
  • Sexual orientation

Lawful bases

For the processing your personal data for your use of the Uploader, administering the Sir Terry Wogan Fundraiser of the Year Award, related promotional activity, filming/recording and broadcasting and other similar opportunities the BBC’s lawful basis is the performance of its public task (the BBC’s role is to act in the public interest and to serve all audiences with content which informs, educates, and entertains) and BBC Children in Need’s lawful basis is that it is in its legitimate interests to undertake fundraising and related activities to further its charitable objectives.

The legal basis on which we  processes your personal data for the verification checks detailed above is the BBC and BBC Children in Need’s Legitimate Interest to protect our reputations and that of the Sir Terry Wogan Fundraiser of the Year Award.   If we process your special category personal data and/or criminal convictions data, the BBC will process this data on the basis of substantial public interest to protect its reputation and BBC Children in Need will process this data on the basis of your consent.

BBC and BBC Children in Need also have a legal obligation to process the personal data of those shortlisted and winner(s) in order to comply with relevant competition regulations.
